These Terms of Use (“Terms”) are a binding agreement between you and Broadcast Media Inc, doing business as EquityExpress.net (“EquityExpress,” “we,” “us,” or “our”), governing your access to and use of https://equityexpress.net and its content, forms, and messaging program (collectively, the “Site”). By using the Site you accept these Terms. If you do not agree, do not use the Site. Please note that Section 12 contains an arbitration agreement and class-action waiver that affect your legal rights.

1. Educational content only — not advice, not a lender

The Site provides general educational information about home equity in the United States. Nothing on the Site is financial, investment, legal, tax, insurance, or real estate advice, and nothing on the Site is an offer, solicitation, or recommendation of any loan, security, or transaction. EquityExpress is not a lender, mortgage broker, loan originator, real estate brokerage, or adviser of any kind, and no content, form submission, or conversation creates an advisory, fiduciary, attorney-client, or broker-client relationship. Information may not reflect the most current legal or market developments and may not apply to your circumstances. Before making decisions about your home or finances, consult qualified, licensed professionals.

2. Eligibility

The Site is intended for users in the United States who are at least 18 years of age. By using the Site, you represent that you meet these requirements.

3. Acceptable use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • scrape, harvest, or systematically extract content or data, including for training machine-learning models, without our written permission;
  • attempt to gain unauthorized access to any systems, or probe, disrupt, or overload the Site;
  • submit false, misleading, or infringing material through our forms;
  • impersonate any person or misrepresent your affiliation; or
  • use the Site to transmit malware, spam, or other harmful material.

We may suspend or terminate access for violations, and we may remove or refuse any submission.

4. Intellectual property

The Site and its contents — text, guides, graphics, design elements, logos, and underlying code — are owned by Broadcast Media Inc or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may quote brief excerpts with attribution and a link. Any other reproduction, distribution, or creation of derivative works requires our prior written consent. All rights not expressly granted are reserved.

5. Submissions

If you send us questions, suggestions, corrections, or other material, you grant us a perpetual, irrevocable, royalty-free license to use them to operate and improve the Site (for example, to fix an error you report or answer a common question), without compensation or attribution obligations. Do not send confidential information.

6. Text messaging program

Participation in our text update program is governed by our Messaging Terms, which are incorporated into these Terms by reference. Consent to receive messages is never a condition of purchasing any property, goods, or services.

7. Third-party links and resources

The Site links to third-party websites and resources for convenience. We do not control and are not responsible for their content, accuracy, or practices, and a link is not an endorsement. Your use of third-party sites is at your own risk and subject to their terms.

8. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT CONTENT IS CURRENT, COMPLETE, OR APPLICABLE TO YOUR SITUATION. YOUR USE OF THE SITE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO SOME EXCLUSIONS MAY NOT APPLY TO YOU.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BROADCAST MEDIA INC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST EQUITY OR PROPERTY VALUE, OR COSTS OF SUBSTITUTE SERVICES — ARISING FROM OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

10. Indemnification

You agree to defend, indemnify, and hold harmless Broadcast Media Inc and its officers, directors, employees, and agents from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Governing law

These Terms and any dispute arising from them or the Site are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, and subject to the arbitration agreement below.

12. Arbitration agreement and class-action waiver

Please read this section carefully — it requires individual arbitration of disputes and waives jury trials and class actions.

  • Informal resolution first. Before filing any claim, you agree to contact us at [email protected] and allow 30 days to attempt informal resolution.
  • Binding arbitration. Any dispute, claim, or controversy arising out of or relating to the Site or these Terms that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in English, by a single arbitrator, and may proceed remotely or in the county where you reside. Judgment on the award may be entered in any court of competent jurisdiction.
  • Class-action waiver. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
  • Exceptions. Either party may bring an individual claim in small claims court, or seek injunctive relief for intellectual-property infringement, without arbitrating.
  • 30-day opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, with the subject “Arbitration Opt-Out” and your name and contact information. Opting out does not affect any other provision of these Terms.

13. Changes to the Site or Terms

We may modify or discontinue the Site at any time. We may revise these Terms by posting an updated version with a new effective date; material changes will be reflected on this page. Continued use of the Site after changes take effect constitutes acceptance.

14. Severability; entire agreement; waiver

If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy, Messaging Terms, and other policies posted on the Site, are the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of it.
